Who is who? by Dr. Thomas Hofer-Zeni Photo:Spencer-Fotolia.com Eine der Möglichkeiten des Internets ist, dass man sich hin- ter Usernamen verstecken kann, um seine Identität zu ver- bergen. Damit muss einem aber auch klar sein, dass auch die wahre Identität des Gesprächs- oder Vertragspartners nie mit Sicherheit feststeht. Wie oft kommt es vor, dass jemand Kennung und Passwort eines anderen benützt, um etwas anzusehen, zu bestellen oder auch nur um in ein Forum einzusteigen. Dies geschieht häufig mit aber auch oft ohne Wissen des Berechtigten. Ebenso ist es möglich, dass – gerade bei Vertragsabschlüssen – der Be- rechtigte sich auf eine unbefugte Nutzung ausredet, um einer Verpflichtung aus dem Vertrag zu entgehen. eBay versucht in den Allgemeinen Geschäftsbedingungen der- artigen Problemen vorzubeugen, indem es dort vorgesehen ist, dass die Mitglieder für sämtliche Aktivitäten haften, die unter Verwendung des Mitgliedskontos vorgenommen werden. Ob diese Regelung durchsetzbar ist, und ob die Verwendung eines fremden Benutzernamens automatisch zu einer vertraglichen Haftung des Berechtigten führt, hat der Bundesgerichtshof nunmehr entschieden. In diesem Fall hat der Verlobte der Inhaberin des Mitglieds- kontos unter ihrem Konto eine komplette Gastronomie-Ein- richtung angeboten, für die der Kläger ein Maximalangebot abgab. Vor Ablauf der Auktion wurde das Angebot zurückge- nommen. Der Kläger beharrte nunmehr auf der Erfüllung des Vertrages, d.h. auf Lieferung bzw. auf Zahlung des Schadenersatzes ge- genüber der Verlobten, mit dem Argument, dass es ja ihr Mit- gliedskonto gewesen sei und eben gemäß den Bedingungen von eBay jeder für die Aktivitäten unter Verwendung des Mit- gliedskontos haften soll. Die Beklagte erwiderte, dass sie von der (unbefugten) Nutzung ihres Kontos durch ihren Verlobten keine Kenntnis gehabt hätte und daher auch nicht zur Verant- wortung gezogen werden könne. Der Bundesgerichtshof folgt diesem Standpunkt. Er führt aus, dass die Geschäftsbedingungen von eBay nur im Verhältnis zwischen dem Mitglied und eBay gelten, allerdings nicht im One of the possibilities of the Internet is that you can hide behind a user name to conceal your identity. It’s equally possible that the other person uses “unauthorised use” as an excuse to get out of contractual obligations, even on conclusion of the contract. eBay attempts to prevent these types of problems in their General Terms & Conditions of Business which provides that members are liable for all activity carried out with their user account. The issues of whether this is actually enforceable and whether using another person’s user name automatically leads to contractual liability for the account holder themselves has now been decided by the Bundesgerichtshof (Federal Supreme Court). In this instance the fiancé of the account holder put a complete set of catering equipment up for auction which the Applicant placed a maximum bid on. The auction was withdrawn before it expired. The Applicant then insisted that the contract be fulfilled i.e. that delivery be carried out or the fiancée pay damages. The Applicant argued that it was her account and she should be liable for the activity carried out with her user account in ac- cordance with the eBay T&Cs. The Respondent countered that she had had no knowledge of the (unauthorised) use of her account by her fiancé and therefore could not be responsible. The Bundesgerichtshof took the following view.
